Hi dears,
My Daughter came as permanent resident on November 2011, I am her dad and have her full custody as the mom is still back in our country of origin. I am Canadian citizenn. She is 12 turning 13 in August. I then have applied for the Canadian child tax benefit and they told me that she didn't fulfil the residence criteria. I am not sure if it is the same application for the Ontario Child tax Benefit, but so far I haven't received anything for my daughter. Can you give me an advice on how I should apply to get child benefit for my daughter.

Hello,
Thanks for sharing your situation with us.
According to the Canada Revenue Agency website in the Canada Child Tax Benefit guide in the Are you eligible? section,
“To get the CCTB, all of the following conditions must be met:
1. You must live with the child, and the child must be under 18 years of age.
2. You must be the person primarily responsible for the care and upbringing of the child. We define primarily responsible above.”
3. You must be a resident of Canada for tax purposes. We consider you to be a resident of Canada when you establish sufficient residential ties in Canada. For more information, see Interpretation Bulletin IT-221, Determination of an Individual's Residence Status.
4. You or your spouse or common-law partner must be: i. a Canadian citizen; ii. a permanent resident (as defined in the Immigration and Refugee Protection Act); iii. a protected person (as defined in the Immigration and Refugee Protection Act); or iv. a temporary resident (as defined in the Immigration and Refugee Protection Act) who has lived in Canada throughout the previous 18 months, and who has a valid permit in the 19th month other than one that states “does not confer status” or “does not confer temporary resident status.” If this is your situation, do not apply before the 19th month.”
We suggest that you contact the Canada Child Tax Benefit enquiries line for additional information and clarification on your situation. You may also want to ask them what needs to be done for her to meet the requirements that they state she has not met.
You may also want to contact the nearest Community Legal Clinic for some additional information on how to proceed.
